What Those Involved May Want to Know
When a person is killed in a vehicle crash involving a family member, the legal and insurance questions that follow can be particularly difficult to navigate. The family relationship does not necessarily prevent insurance benefits or a potential civil claim, but the available options depend on the circumstances of the crash and the applicable insurance coverage.
Under Michigan’s wrongful death statute, MCL 600.2922, a wrongful death action may be available when a death results from another party’s wrongful act, neglect, or fault. Whether a wrongful death claim may apply here will depend on what the investigation establishes about the circumstances of the crash.
Michigan’s no-fault system may provide certain benefits following a fatal motor vehicle crash, depending on the circumstances and applicable insurance coverage. Other potential claims may also depend on the terms of the relevant policies and what the investigation establishes about how the crash occurred.
Because the driver and victim were family members, questions about available coverage may be especially important. An auto accident attorney can review the applicable insurance policies, determine what benefits or coverage may be available, and explain the family’s options.
Seeking legal guidance in a crash involving a family member does not necessarily mean pursuing an adversarial case against that person. It can help the family understand available insurance coverage and the legal options that may exist.
