Pedestrian Killed After Being Struck by Car on Woodward Avenue in Oakland County [ Oakland County, MI]

A 59-year-old Pontiac man lost his life on Monday morning, April 6, 2026, after being struck by a vehicle while attempting to cross Woodward Avenue in Oakland County. The fatal incident occurred near South Boulevard at approximately 9:30 a.m. and was reported by the Oakland County Sheriff’s Office. The story was published on April 7, 2026.

According to authorities, the Pontiac man was attempting to cross Woodward Avenue when he was struck by a 2026 BMW X5 operated by a 37-year-old man from Waterford Township. The pedestrian was pronounced dead at the scene. The driver of the BMW was uninjured. Investigators noted that the pedestrian was outside of a marked crosswalk at the time of the collision. The victim’s identity has not yet been publicly released, as authorities are still in the process of notifying next of kin.

Oakland County Sheriff’s Office investigators responded to the scene and conducted field sobriety testing on the driver, who passed. Authorities stated that neither drugs nor alcohol are believed to be contributing factors in this crash. The investigation remains open and ongoing.

Understanding the Legal Implications of This Crash

When a pedestrian is killed by a vehicle in Michigan, the legal questions that follow can be complex — especially when the collision occurs outside of a designated crosswalk. Under Michigan law, both drivers and pedestrians share responsibilities on the road. Drivers are required to exercise reasonable care to avoid striking pedestrians, even those who may not be in a marked crossing. At the same time, pedestrians who cross outside of crosswalks may share some degree of fault under Michigan’s comparative negligence rules. How fault is allocated in a case like this can significantly affect the compensation available to surviving family members through a liability claim.

The fact that the driver passed field sobriety tests and that alcohol and drugs are not believed to be factors does not automatically extinguish civil liability. Other considerations — including vehicle speed, visibility conditions, the driver’s attentiveness, and whether the pedestrian was visible and predictable in his path — may all be relevant to a civil negligence analysis. Michigan courts have long recognized that the duty of care owed to pedestrians is substantial, and that drivers must remain alert to the possibility that pedestrians may appear at unexpected locations along heavily traveled roads like Woodward Avenue.

When a family loses a loved one in a traffic fatality, Michigan law allows eligible surviving family members to pursue a wrongful death claim. These claims can seek compensation for loss of companionship, the family’s emotional suffering, funeral and burial expenses, and the financial contributions the deceased would have provided over the course of their lifetime. Given that the investigation is still ongoing, it is important for surviving family members to consult with an attorney promptly — both to protect their legal rights and to ensure that critical evidence is preserved during the investigative phase.
