According to Berkley police, the crash occurred just after 10 p.m. in the area of Edgewood Avenue and Henley Street. A 2021 Chevrolet Blazer struck a tree and caught fire. The driver, a 40-year-old Troy resident, remains hospitalized. The passenger, a 52-year-old Warren resident, later died from their injuries. Police suspect speed and the possible use of alcohol and/or controlled substances were factors in the crash. The investigation is ongoing.
What those involved may want to know.
When a passenger is killed in a single-vehicle crash and the investigation identifies speed and possible substance use as contributing factors, the legal questions for the surviving family depend on what the investigation ultimately establishes about the cause of the crash and the conduct of the driver.
Under Michigan’s wrongful death statute, MCL 600.2922, the personal representative of the deceased passenger’s estate may have grounds to pursue a civil wrongful death action if the death resulted from another party’s wrongful act, neglect, or fault. Whether that applies here depends on facts the investigation has not yet fully established, including what caused the vehicle to leave the roadway and whether speed, alcohol, or controlled substances contributed to the crash.
Michigan’s no-fault system may provide certain benefits to eligible survivors depending on the applicable insurance coverage. An auto accident attorney can help the family identify what coverage may apply and evaluate what legal options may be available as the investigation develops.
